Man sues Superior Marine Ways for injuries

HUNTINGTON – A man is suing Superior Marine Ways Inc. for injuries he sustained on the job.


Kevin Dillon was an employee of the defendant and on June 21, he was required to negotiate an unreasonable distance between two vessels, a barge and a tow bow, neither of which had ladders, steps or other aid, according to a complaint filed Feb. 25 in the U.S. District Court for the Southern District of West Virginia.


Dillon claims he was injured and the defendant failed to exercise reasonable care regarding his medical management, causing an aggravation and/or prolongation of the injury.


The defendant's actions caused or contributed to Dillon's damages, according to the suit.


Dillon claims he suffered mortification, humiliation, fright shock and embarrassment; loss of earnings and earning capacity; hospital, pharmaceutical and other expenses; aggravation and/or prolongation of prior condition; inability to engage in social recreational and other pursuits previously enjoyed; pain and suffering; and mental anguish.


Dillon is seeking compensatory damages He is being represented by Dennis M. O'Bryan of O'Bryan Baun Karamanian; and Andrew J. Katz.


The case is assigned to District Judge Robert C. Chambers.
