Woman says Pearson employee assaulted her

CHARLESTON – A woman who claims she was assaulted by an unknown employee is suing Pearson Education for her damages.


The unknown employee who assaulted the plaintiff was also named as a defendant in the suit.


Alisa Proklevich was attempting to pass an exam to become licensed to sell property and casualty insurance and arrived at Pearson's testing location and, after signing in, she encountered a Pearson employee who made inappropriate comments of a sexual nature to her, according to a complaint filed Jan. 22 in Kanawha Circuit Court.


Proklevich claims the employee then grabbed her crotch and attempted to grab her hand. He later gave her a note that stated he would like to have sex with her and asked if she would meet him in the garage.


The unknown employee worked under the authority of Pearson and was acting within the scope of his employment  and as such, Pearson is vicariously liable for his conduct, according to the suit.


Proklevich claims Pearson was aware of the unknown employees' propensities for inappropriate behavior because of similar inappropriate acts.


The defendants violated the West Virginia Human Rights Act and caused Proklevich damages, according to the suit.


Proklevich is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Paul M. Stroebel of Stroebel & Johnson PLLC.
