Man sues Kroger for broken leg

CHARLESTON – A man who was injured at Kroger is suing the company for damages.


On Jan. 28, 2013, Mark Greathouse was on the loading dock of Kroger's premises when he fell and was injured, according to a complaint filed Jan. 26 in Kanawha Circuit Court.


Greathouse claims he was exposed to hazardous weather conditions, which were not properly maintained and suffered a fracture to his lower leg.


The defendant's failure maintain its premises caused Greathouse to suffer mental anguish and distress; pain and suffering; medical expenses; lost earnings and lost earning capacity; loss of household services; aggravation, annoyance and inconvenience; and loss of enjoyment of life, according to the suit.


Greathouse is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Thomas H. Peyton of Peyton Law Firm PLLC.


The case is assigned to Circuit Judge Joanna Tabit.
