BECKLEY — A North Carolina couple sued a ski resort, alleging negligence and causing personal injury.
Barbara Lynn and Tony Manuel Lynn, of Gastonia, filed a lawsuit Feb. 26 in Raleigh Circuit Court against New Winterplace LLC and New Winterplace Inc., alleging personal injury in a 2013 incident.
According to the complaint, the defendant operates the Winterplace Ski Resort in Flat Top, and on March 2, 2013, Barbara Lynn was walking a pedestrian route on the defendant’s property when she slipped and fell. The suit states the facility had left the walking area unattended until snow and ice buildup became dangerous. The suit alleges the defendant neither maintained its premises safely nor warned patrons of the hazardous nature of its walkways.
The Lynns charge breach of duty and negligent misrepresentation.
The couple seeks damages for injuries, pain and suffering; inconvenience; loss of service and companionship; loss of enjoyment of life and emotional distress; attorneys fees; and court costs.
They are represented by attorney Anthony J. Sparacino Jr. of Beckley. The case has been assigned to Circuit Judge John A. Hutchison.
