BECKLEY — A Florida woman filed suit against a Daniels resort for allegedly causing her personal injuries sustained in February 2013.
Ruth Smalley, of Cape Coral, brought a lawsuit against the Resort at Glade Springs, on Feb. 25 in Raleigh Circuit Court.
According to the complaint, on Feb. 26, 2013, the plaintiff slipped on ice in the parking lot of the facility, located at 255 Resort Drive in Daniels. Alleging that she fell to the ground violently, Smalley claims that the defendant was careless, negligent and reckless in failing to inspect and maintain the parking lot surface; warn guests of the hazard or post signs; and/or block off icy areas to divert traffic.
Citing extensive medical treatment following her injuries, the plaintiff seeks: compensation for medical expenses; pain and suffering; distress; attorneys’ fees; and court costs.
She is represented in the case by Eric Chaffin and Patrick Booth of Chaffin Luhana in Weirton. The case has been assigned to Judge Robert A. Burnside.
