Shopper alleges injuries from improper lighting

BECKLEY — A Raleigh County woman has sued a retail store, alleging negligence in a personal injury.

Clarissa Smith of Shady Spring filed a lawsuit March 3 in Raleigh Circuit Court against Party City Corporation doing business as Halloween City of Charleston, alleging injury liability.

According to the complaint, on Sept. 10, 2014, Smith fell while shopping at Party City's store in Beckley. The suit states the accident was due to poor lighting and that the retailer was negligent in its duty to protect Smith and other customers.

The suit says the fall caused Smith to experience medical bills and permanent injuries.

Smith seeks compensatory damages for her injuries, plus attorney fees and costs. She is represented by attorney Greg Hewitt of Hewitt & Salvatore in Fayetteville.
