CHARLESTON – A Charleston man is suing the Charleston Police Department for being negligent and causing him injuries.
The City of Charleston and Gary R. Daniels, an employee of the city, were also named as defendants in the suit.
On Feb. 10, 2013, Wilbert C. Gore Jr. was operating a 1998 Buick Park Avenue in Charleston when Daniels, who was operating a 2013 Ford Taurus owned by the police department, collided with him, according to a complaint filed Feb. 5 in Kanawha Circuit Court.
Gore claims he was seriously and severely injured in and about his neck, back and arms as a result of the accident.
As a further direct and proximate result of the negligence, Gore has undergone painful and extensive medical care and treatment; and incurred medical bills and expenses, according to the suit.
Gore claims the defendants were negligent and caused him sustain a loss of earnings and a future earning capacity.
Daniels had a duty to operate the vehicle in a reasonably safe manner and breached his duty, according to the suit.
Gore is seeking compensatory damages.
He is being represented by Matthew R. Oliver of Vital & Vital. The case is assigned to Circuit Judge Louis Bloom.
