Woman blames Speedway for injuries

CHARLESTON – A Kanawha County woman is suing Speedway after she claims its premises were unsafe.


On Feb. 7, 2013, Mary Ann Cantley was walking in the gas pump area of Speedway when she tripped over broken cement protruding from the ground and fell, causing her physical injuries, according to a complaint filed Feb. 4 in Kanawha Circuit Court.


Cantley claims her injuries were caused by Speedway's negligence in that the defendant maintained unsafe premises and failed to repair the broken cement.


The defendant's actions caused Cantley to suffer serious medical injuries, including injuries to her face, knee and back, according to the suit.


Cantley claims she also suffered medical expenses; annoyance and inconvenience; permanent injury; and other injuries.


As a direct and proximate result of the defendant's negligence, Cantley is entitled to damages for indignity, embarrassment, aggravation, annoyance, inconvenience and mental anguish, according to the suit.


Cantley is seeking compensatory damages. She is being represented by Richelle K. Garlow of the Law Office of Michael T. Clifford.


The case is assigned to Circuit Judge Carrie Webster.
