ELIZABETH — A Wirt County couple filed has sued General Motors, alleging workmanship defects in a 2012 purchase.
Michael and Christina Whited of Elizabeth field a lawsuit March 20 in Wirt Circuit Court against General Motors, alleging their newly purchased vehicle was defective.
According to the complaint, on Sept. 5, 2012, the couple bought a 2012 GMC Terrain manufactured by GM from Matheny Motors in Parkersburg, and GM warranted the vehicle to be free from defects and fit for its intended use for three years or 36,000 miles.
The suit says shortly after the transaction, the plaintiffs experienced odd engine noises, loss of oil and loss of power when going uphill. Alleging they brought the vehicle to the dealership for repair on several occasions, the Whiteds cite poor workmanship and craftsmanship on GM’s part and say they have sustained diminished market value of their investment.
The plaintiffs cite breach of express and implied warranty, loss of use of their vehicle and a general safety risk posed by their purchase, and argue the defendant and its authorized agents were unable to make repairs satisfactorily or within a reasonable period of time. The Whiteds allege specific infringement of the Magnuson-Moss Warranty Act.
The plaintiffs seek: revocation of the acceptance of their vehicle; refund of their purchase price and all fees; and damages for inconvenience and the cost of attempted repairs, pre- and post-judgment interest; attorney fees; and costs. They are represented by attorney John Ellem of Ellem Law Office in Parkersburg. The case has been assigned to Circuit Judge Robert A. Waters.
