MARLINTON — A Pocahontas County commercial laundry equipment provider has sued a service firm, alleging breach of contract.
Tri-State Technical Services Inc., doing business at TLC Equipment, filed a lawsuit March 18 in Pocahontas Circuit Court against Mountain Linen Services, alleging breach of a 2014 contract.
The complaint states on May 13, 2014, the defendant entered into two contracts with Tri-State Technical totaling more than $340,000.
Tri-State delivered equipment to the defendant and invoiced them in November and December 2014, the suit states, and having received no payment by the end of the year, the plaintiff gave public notice of its right to repossess and/or sell the defendants assets.
The plaintiff issued Mountain Linen a final demand for the $107,720.22 balance due Feb. 9, the suit states, and received $16,011 the following day. Tri-State alleges Mountain Linen still owes $91,709.22, and requests declaratory judgment to regain possession of the equipment.
