Woman blames housing authority, elevator company for injuries

WHEELING — An Ohio County woman has sued a housing authority and elevator manufacturer, alleging negligence for injuries received in a 2013 accident.

Christine L. Miller, formerly known as Christine L. Gerrero, of Wheeling, filed a lawsuit March 13 in Ohio Circuit Court against Wheeling Housing Authority Resident Council Inc., also known as Wheeling Housing Authority, and Otis Elevator Company, alleging negligence.

According to the complaint, Otis had installed and maintained an elevator at the plaintiff’s residence, Garden Park Terrace Apartments, 1208 Warwood Ave., Wheeling, and managed by the Wheeling Housing Authority. The suit states on March 13, 2013, Miller fell while exiting an elevator in the building and was injured on her head, neck, shoulders, back, chest, arms, legs, knees, ankles, body chemistry and psyche.

The plaintiff alleges: great pain and suffering; medical expenses; inconvenience; lost wages and diminished earning capacity; and loss of ability to enjoy life. She cites both defendants with counts of negligence, arguing they should have been aware of dangerous conditions.

Miller seeks compensatory and general damages, plus attorney fees and costs.

She is represented by attorney Shane Mallett of Mallett Law Offices in Wheeling. The case has been assigned to Circuit Judge Ronald E. Wilson.
