CHARLESTON – A lawsuit has been filed against Mardi Gras Casino & Resort for alleged patent infringement.
Racing Corporation of West Virginia is doing business as Mardi Gras Casino & Resort.
Hawk Technology System was formed in 2012 to commercialize the inventions of its founder, Barry Schwab, according to a complaint filed last month in the U.S. District Court for the Southern District of West Virginia.
Schwab and Ken Washino invented what is claimed by the '462 patent and have collaborated on a number of other inventions, including patents in the areas of video archiving, video downloading and digital cinema. Schwab is also a named inventor on more than 30 patents, ranging from consumer products to secure network computing.
Without Hawk's authorization, the defendant used a video storage and display system and/or methods that infringe on one or more of the claims of the '462 patent and have caused Hawk to be damaged by the infringement, according to the suit.
Hawk is seeking the court enter a judgment finding that the defendant directly infringed on the '462 patent and that the defendant pay damages adequate to compensate for the infringement. It is being represented by Damon L. Ellis of Mani Ellis & Layne PLLC; and Gregory J. Myers of Lockridge Grindal Nauen PLLP.
