CHARLESTON – A Kanawha County woman is suing Southridge Grand Prix & Family Fun Center for injuries she sustained while roller skating on its property.
On April 18, Deltadawn Shamblen was on the defendant's property for the purpose of roller skating with her children, according to a complaint filed Feb. 19 in Kanawha Circuit Court.
Shamblen claims while roller skating, her skate was caught on a cracked, uneven portion of the surface of the roller skating rink resulting in her falling and sustaining injuries.
As a direct and proximate result of the defendant's gross negligence, willful, wanton and reckless conduct, the plaintiff suffered damages, including mental anguish and distress; pain and suffering; medical expenses; lost earnings and lost earning capacity; loss of household services; aggravation, annoyance and inconvenience; and loss of enjoyment of life, according to the suit.
Shamblen is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Thomas H. Peyton of Peyton Law Firm PLLC.
The case is assigned to Circuit Judge Carrie Webster.
