Woman sues housing authority for injuries from fall

CHARLESTON – A Charleston woman is suing the Charleston-Kanawha Housing Authority for injuries she sustained during a fall on its property.


On Sept. 30, 2013, Margaret Heck fell on a newly constructed sidewalk of the defendant's housing unit, according to a complaint filed Feb. 6 in Kanawha Circuit Court.


Heck claims the defendants owed a duty of reasonable care under all the circumstances to provide reasonably safe premises for tenants and failed to meet that duty.


The defendant failed to remedy the hazardous condition, failed to reinstall handrails that previously existed and failed to warn of the hazardous condition by other acts and/or omissions, according to the suit.


Heck claims the defendant's failures proximately caused or contributed to injuries she sustained as a result of her fall.


The defendant's negligence caused Heck to suffer a broken wrist; requiring medical treatment for which she has incurred; necessary and reasonable medical expenses; great pain and suffering; loss of enjoyment of life; and other damages, according to the suit.


Heck is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Scott H. Kaminski of Balgo & Kaminski LC.


The case is assigned to Circuit Judge Charles King.
