Mine equipment firm files breach of contract suit

PRINCETON — A Pennsylvania company has sued a Mercer County company, alleging breach of contract.

Brookville Equipment Corp. of Brookville, Pa., filed a lawsuit March 16 in Mercer Circuit Court against Rumble Seat Motors Inc., doing business as RJ Mine Services of Princeton, alleging breach of contract in an ongoing payment dispute.

According to the complaint, Brookville Equipment and the defendant entered into a business agreement around 2005 in which RJ Mine Services became an authorized service center of Brookville. The suit says the defendant was to provide component repair and rebuilding, service calls and evaluations for the plaintiff’s customers.

RJ Mine Services periodically purchased parts from Brookville pursuant to their agreement between 2005 and 2014, the suit states, but starting around November 2013, RJ Mine failed to make payments for its purchases even though the plaintiff fulfilled its contractual obligations by delivering parts ordered.

The plaintiff alleges violation of their agreement and cites breach of contract and unjust enrichment.

Brookville Equipment seeks damages of $559,319 plus interest, attorney fees, costs and other damages the court deems appropriate. It is represented by attorney Mark Lazenby of Lazenby Law Office in Princeton.
