LOGAN — A Logan County woman filed a lawsuit against her local public school jurisdiction on behalf of her daughter for an alleged injury on school property in 2013.
Crystal Compton, in her own right and on behalf of Victoria Compton, a minor, brought a lawsuit against the Logan County Board of Education on March 12 in Logan Circuit Court, claiming negligence in the October 2013 incident that injured her daughter.
According to court documents, Victoria, then age 10, was playing during recess at Buffalo Elementary School on Oct. 9, 2013, when a swing she was swinging on broke and she fell to the ground, breaking both wrists.
As a result of the accident, the girl underwent surgery and physical therapy, was restricted to home schooling and was limited in her daily activities, the suit states.
The plaintiff alleges that the defendant had a duty to exercise reasonable care in providing a safe playground, proper supervision and safe equipment, and that it was negligent in failing to inspect the playground apparatus.
Citing pain and suffering and medical expenses, Compton is seeking damages plus attorneys’ fees and costs.
The plaintiff is represented in the case by John Skaggs of The Calwell Practice in Charleston. The case has been assigned to Judge Roger L. Perry.
