Woman says daughter was hurt during nature activity

WAYNE – A parent is suing the Wayne County Board of Education after she claims her daughter was injured while in the school board's care.


On May 20, 2011, Hailey Adkins was a student at Wayne Middle School and was taken outside by Brainard Adkins II, an employee of the board, for a nature activity without the permission of the school or the students' parents, according to a complaint filed March 16 in Wayne Circuit Court.


Kelly Adkins claims while Hailey Adkins was walking down a hillside, she slipped and fell and sustained serious personal injuries.


The school board had a duty to supervise the actions and conduct of its employees and to safeguard its students and protect them from any harm, according to the suit.


Kelly Adkins claims the defendant was negligent in the selection, training and retention of employees whose duties were to protect students and failed to keep her child safe from harm when it allowed its employee to remove students from the school's premises without permission and into an area where dangerous and defective conditions existed.


Hailey Adkins suffered  physical and mental pain and suffering; a diminution of her capacity to enjoy life; embarrassment and humiliation; annoyance and inconvenience; and incurred expenses for medical care, according to the suit.


Kelly Adkins is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Juston H. Moore.


The case is assigned to Circuit Judge Darrell Pratt.
