Paycheck

NEW CUMBERLAND — A Hancock County woman filed a class action complaint against her former employer for matters related to a wage dispute in 2014 and 2015.

Glenda L. Mobley-Robinson of Weirton brought allegations against Medical Billing and Management Services Inc., headquartered in Tampa, Fla., on March 18 in Hancock Circuit Court, claiming violation of employment laws in 2014-15.

According to papers filed, Mobley-Robinson worked at the defendant’s West Virginia facility between January 2014 and March 2015. She alleges infringement of the West Virginia Minimum Wage and Maximum Hours Standards law and the West Virginia Wage Payment and Collection Act.

The suit states that the plaintiff was discharged on March 13, 2015, and that subsequent to her dismissal the defendant did not pay Mobley-Robinson her wages in a full and timely manner as required by law, within 72 hours.

Alleging breach of contract and wrongful conduct, the plaintiff seeks actual, liquidated and treble damages, pre- and post-judgment interest, attorneys’ fees and costs for herself and the proposed class members.

Randolph is represented by Carl Frankovitch and Kevin Pearl of Frankovitch, Anetakis, Colantonio & Simon of Weirton. The case has been assigned to Judge David J. Sims.
