POINT PLEASANT — A Mason County resident filed a lawsuit against two trucking companies and a driver for alleged negligence in a 2013 traffic incident.
David M. Johnson of Ashton, brought a complaint against Conley Trucking LLC and Delmas Conley Trucking of Wheelersburg, Ohio; and Thomas E. Newton of Minford, Ohio, on March 26 in Mason Circuit Court, claiming liability in a June 2013 mishap.
Johnson was driving a 1999 Dodge Caravan eastbound on Mercer Bottom Road, also known as Bladen Lane, on June 26, 2013, with the intention of making a right-hand turn onto WV Route 2 in Mason County.
According to the suit, Newton entered the southbound lane of Route 2 to pass a vehicle driven by a third party, Kenneth Daniel Saunders. Newton allegedly braked, swerved and lost control of his vehicle, striking both cars.
The suit states that Newton’s trailer wheels and axle collided with the front of the plaintiff’s Caravan.
Johnson contends severe injuries requiring medical treatment, expenses and lost wages.
The plaintiff seeks damages, attorneys’ fees and costs. Johnson is represented by Michael Olivio and Travis Griffith of Olivio & Griffith in Charleston and John Proctor of Proctor Law Offices in Huntington. The case has been assigned to Judge David W. Nibert.
