Phone book publisher files breach lawsuit

WINFIELD — A Putnam County firm filed a lawsuit against a moving company for its alleged breach of a 2010 agreement.

Supermedia LLC, also known as IDEARC Media LLC, brought litigation against Central Van and Storage of Charleston Inc. of Poca in Putnam Circuit Court on March 23, claiming default of payment in a 2010 matter.

The plaintiff publishes Verizon print directories. Supermedia LLC alleges default of an advertising agreement first executed March 11, 2010. Court documents indicate that the defendant is in arrears for directory advertising appearing in the Pittsburgh Yellow Pages.

According to the complaint, the amount in question remains due and payable in full; court papers show that allegedly no funds were ever remitted for this particular account to the publishing company.

Alleging breach of contract, Supermedia seeks to be awarded the sum of $29,777.55; plus $200 for a court filing fee, as well as a $25 service fee; interest, attorneys’ fees and costs. Affidavits, advertising agreements and billing statements were all provided to the court by the complainant as documentation in the matter.

The plaintiff is represented by James Atkins, Paul Atkins and Bree Ogle of Atkins and Ogle Law Offices of Buffalo.
