BECKLEY — A Raleigh County physician filed a lawsuit against his employer for alleged breach of a 2010 agreement.
Narciso A. Rodriguez-Cayro brought litigation against Beckley Pain Clinic PLLC (BPC) on March 21 in Raleigh Circuit Court, claiming breach of contract.
According to court documents, the plaintiff was employed by the defendant as a pain management specialist, having entered into a three-year contract beginning Dec. 5, 2010. According to court documents, the agreement specified a salary totaling $350,000 annually, payable on a bi-weekly basis, plus regular quarterly bonuses.
The plaintiff alleges that he was never paid his bonuses during the time of his employment with BPC, from December 2010 to February 2014. The doctor supplied evidence in his filing that BPC notified him of the agreement’s alleged self-expiration in December 2013. Court documents indicate that he received a letter from BPC’s attorney dated Feb. 24, 2014, advising him of his termination.
Citing the defendant with breach of contract, Rodriguez-Cayro requests judgment, pre- and post-judgment interest, attorneys’ fees and costs.
