Ripley woman files slip-and-fall suit against Olive Garden

HUNTINGTON – A Jackson County woman has sued the owner of the Olive Garden in Barboursville for injuries she allegedly suffered in a fall.

Guadalupe C. Valdez of Ripley filed a lawsuit Jan. 9 in Cabell Circuit Court against GMRI Inc., doing business as Olive Garden, 12 Mall Road, Barboursville.

According to the complaint, on Jan. 13, 2013, Valdez was at the Olive Garden when she slipped and fell from water on the floor, causing "severe and debilitating injury." The suit says the defendants were negligent in their: failure to maintain a safe premises; failure to perform proper maintenance and inspection of the property; failed to adequately train personnel; failed to warn customers about potential hazards; failure to exercise due care; and other acts and omissions known or unknown to Valdez.

The plaintiff cites negligence and carelessness.

Valdez seeks unspecified damages, plus pre- and post-judgment interest, expenses and costs. She is represented by attorney Kathy A. Brown of Kathy Brown Law in Charleston.
