HUNTINGTON – Two former employees are suing Tristate Racer after they claim it violated the West Virginia Wage Payment and Collection Act.
Pat Riley Investments LLC is doing business as Tristate Racer and Tristateracer.com.
In July 2011, Richard A. Campbell Jr. and Caren Craigo were employed by TSR to set up and provide timing services for road races, according to two complaints filed in Cabell Circuit Court.
The plaintiffs claim TSR set their schedules and directed their activities at the road races timed by TSR and provided them with all equipment necessary for them to perform their assigned tasks.
During their employments, TSR failed to pay the plaintiffs in compliance with West Virginia code, which requires that employees be paid every two weeks, but, instead, Campbell and Craigo were only paid on a monthly basis, according to the suit.
The plaintiffs claim they resigned on Dec. 3, and, upon receiving notice of their resignations, TSR issued a stop payment on the plaintiffs last paychecks, causing them to overdraw on their bank accounts and incur charges.
When TSR reissued the last paychecks, they failed to compensate them fully for the services he performed for TSR and failed to pay them in full to date, according to the suit.
The plaintiffs claim TSR's conduct violated the West Virginia Wage Payment and Collection Act.
The plaintiffs are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Robert H. Sweeney Jr. of Jenkins Fenstermaker PLLC.
The cases have been assigned to Circuit Judge Christopher D. Chiles.
