WHEELING – A Barnesville, Ohio, couple is suing Ohio Valley Medical Center after injuries were sustained on its property.
Dr. Joseph Petersen was also named as a defendant in the suit.
From April 3, 2013, until April 9, 2013, Marjorie Jordan was a patient of OVMC under the care of Petersen , according to a complaint filed April 2 in Ohio Circuit Court.
Jordan claims due to the defendants' actions and/or inactions, she was caused damage during her time at the hospital.
The defendants had a duty to exercise reasonable care toward Jordan as her known conditions require, the degree of care being in proportion to her known physical and mental ailments, according to the suit.
Jordan claims the defendants had a duty to provide attendance and care as was necessary to prevent reasonable foreseeable injury.
The defendants also failed to warn her of conditions it knew existed that were particularly dangerous, according to the suit.
Jordan claims the defendants also breached its fiduciary duty and violated West Virginia code.
Jordan and her husband, Clayton Jordan, are seeking compensatory and punitive damages. They are being represented by C. Richard Wilson of Wilson Law Offices.
