Woman blames jail authority for brother's death

CHARLESTON – The sister of a deceased inmate is suing the West Virginia Regional Jail and Correctional Facility Authority for her brother's death.


Damien Hollie died while an inmate at the Southern Regional Jail in Beaver on Jan. 10, 2013, according to a complaint filed Feb. 19 in Kanawha Circuit Court.


Tanya Hollie, Damien Hollie's sister, claims the defendant failed to provide her brother with necessary diabetic care, even though they were aware of his medical needs from his prior history at the jail and from his regular urging to them to provide his medications and tend to his medical needs.


Despite having this information, the jail personnel and the medical staff failed to provide the necessary care, according to the suit.


Tanya Hollie claims as a direct and proximate result of the defendant's failure, Damien Hollie passed away from medical complications arising from the failure to receive the necessary care.


The defendant owed Damien Hollie a duty of care to provide necessary and vital medical care to him and failed to do so, thereby breaching its duty, according to the suit.


Tanya Hollie is seeking compensatory damages. She is being represented by James J. Palmer III of the Palmer Law Firm.


The case is assigned to Circuit Judge Louis Bloom.
