Another lawsuit filed against Charleston law firm

CHARLESTON – Another lawsuit has been filed against Michael Martin & Associates and its owner for failing to settle a lawsuit in a timely manner.


Liberty Insurance Underwriters Inc. was also named as a defendant in the suit.


Brandy Pauley was involved in a motor vehicle accident on April 6, 2010, and incurred medical expenses totaling approximately $18,000, according to a complaint filed April 8 in Kanawha Circuit Court.


Pauley claims she hired R. Michael Martin and his law firm to represent her against the parties responsible for the accident and signed a written agreement with the defendants to represent her.


The defendants failed to settle Pauley's action within the applicable statute of limitation of two years from the date of the accident, according to the suit.


Pauley claims as a result of the defendants' failure to either settle her action or file an action in the appropriate court against those responsible, the defendants were negligent.


Because of the defendant's negligence, Pauley is now precluded from recovering against those responsible for the accident and her resulting injuries, according to the suit.


Pauley claims the defendants breached their contract with her and caused her damages.


Pauley is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Gregory W. Sproles of Gregory W. Sproles PLLC.


The case is assigned to Circuit Judge Carrie Webster.


Pauley's is one of multiple lawsuits filed against Michael Martin & Associates this year claiming the law firm was negligent in timely filing lawsuits.
