Former attorney agrees to voluntary disbarment

CHARLESTON – Former Charleston attorney R. Michael Martin has consented to voluntary disbarment.


On Jan. 7, the Lawyer Disciplinary Board filed a motion to file an amended petition for annulment of law license, according to the Jan. 20 order.


The court granted the petition for annulment of law license and Martin's license was annulled by voluntary consent, according to the order.


Martin and Michael Martin & Associates has been named in at least ten lawsuits in Kanawha, Raleigh and Wayne circuit courts since January.


The plaintiffs have claimed that Martin negligently failed to settle lawsuits in a timely manner and that Martin wrongfully distributed settlements to them.


Most of the plaintiffs have been individuals, however, in Raleigh Circuit Court, Erie Insurance Company filed its suit, claiming Martin breached the terms of a settlement agreement.
