Warehouse owner demands rent from lessee

WINFIELD — A Putnam County business filed a lawsuit against a lessee for breach of contract in a 2013 matter.

Brooks Quarrier Associates brought a complaint against Contemporary Galleries of West Virginia Inc. on April 23 in Putnam Circuit Court, claiming breach of contract and fiduciary duty in October 2013.

The plaintiff owns a warehouse building in Rock Branch Industrial Park. Having leased a portion of the premises to the defendant in October 2013, Brooks Quarrier Associates claims that Contemporary Galleries is in arrears in the amount of $32,000 for unpaid rent.

Brooks Quarrier asserts that it has made several requests for remittance and has not received any funds due. According to the complaint, the lessee has failed and refused to make payment in order to satisfy its legal obligation to the building owner.

Brooks Quarrier demands judgment against Contemporary Galleries of West Virginia Inc. in the total amount of $32,000; cost of collection; recognition of a landlord’s lien, and other relief that the court deems appropriate.

The plaintiff is represented by Joseph Caldwell of Caldwell and Riffee in Charleston. The case has been assigned to Judge Phillip M. Stowers.
