Man says he slipped, fell over boxes at Walmart

WHEELING — An Ohio County man filed a lawsuit against a major retailer for premises liability in a 2013 mishap.

John R. Bumbera brought a complaint against Wal-Mart Stores Inc., headquartered in Benton, Ark., and doing business in Ohio County on May 1 in Ohio Circuit Court, claiming negligence in May 2013.

According to the filing, the plaintiff was shopping at the defendant’s store no. 5088 on May 1, 2013, when he slipped and fell in the aisle as a result of encountering boxes on the floor.

The lawsuit cites the defendant with failure to keep the aisle and floor clean and free of objects; post warning signs or barriers to guide traffic around the obstacle; and to keep its premises safe.

Bumbera claims physical injuries with symptoms including headache, knee and back sprains, and general discomfort, along with medical bills. He supposedly sustained pain, suffering and inconvenience; embarrassment, anguish and distress; diminished ability to enjoy life; and general impairment of health.

The plaintiff seeks compensatory and general damages, pre- and post-judgment interest, attorneys’ fees and costs.

Bumbera is represented by Thomas White of the White Law Office in Moundsville. The case has been assigned to Judge Martin J. Gaughan.
