Law firm sues country club for failure to pay

NEW CUMBERLAND – Bernstein-Burkely PC is suing Williams Country Club for failure to pay for legal services.


On Feb. 25, 2014, Williams entered into an engagement letter with Bernstein whereby Bernstein agreed to provide the defendant with certain legal services, according to a complaint filed April 27 in Hancock Circuit Court.


Bernstein claims it provided legal services to the defendant and the defendant received and accepted the legal services.


The prices charged by Bernstein were the fair, reasonable and market prices that prevailed at the times of the transactions, according to the suit.


Bernstein claims as of Jan. 5, a balance of $8,710.49 remains due and owing to it as a result of the defendant's failure to pay for the legal services.


Interest at 18 percent per annum from Jan. 5 through March 16 is $300.69, according to the suit.


Bernstein claims although it was repeatedly requested to do so, the defendant has willfully failed and refused to pay the balance interest or any part of that amount.


Bernstein is seeking judgment in the amount of $9,011.18 with continuing interest on the principal balance at a rate of 6 percent per annum. It is being represented by Shawn P. McClure.


The case is assigned to Circuit Judge David J. Sims.


The suit is the latest in a series of complaints filed over the last two years alleging the country club didn't pay bills.
