Mammoth woman sues Kroger for injuries

CHARLESTON – A Mammoth woman is suing the Kroger Co. after she claims she was injured at its store.


On July 7, 2013 Judith Ann Slate was a customer at Kroger when she fell and became injured, according to a complaint filed April 27 in Kanawha Circuit Court.


Slate claims the defendant was negligent in maintaining its facility and failed to maintain a safe environment for all customers.


The defendants were also negligent in their upkeep of the store, according to the suit.


Slate claims the defendants negligent and careless conduct caused her to sustain serious injury to her mind and body.


Because of her injuries, Slate suffered damages, including physical injury and medical expenses; mental anguish; pain and suffering; annoyance and inconvenience; loss of enjoyment of life; loss of income; and loss of earning capacity, according to the suit.


Slate is seeking compensatory damages with pre- and post-judgment interest. She is being represented by G. Patrick Jacobs of the Law Office of G. Patrick Jacobs.


The case is assigned to Circuit Judge Tod J. Kaufman.
