NEW CUMBERLAND — A Hancock County woman has sued a towing company and its employee, alleging liability in a 2014 accident.
Marilyn Crago of Weirton filed a lawsuit in Hancock Circuit Court against Chaney’s Auto Repair and Towing of Chester, along with its employee John Doe, alleging negligence in a 2014 accident.
According to the complaint, on Nov. 25, 2014, a tow truck owned by Chaney’s and operated by John Doe in the scope of his employment was dispatched to assist Crago when she was a passenger in a car that became disabled in New Cumberland. The suit states Doe hitched the vehicle and raised it onto his truck’s flatbed while Crago was still inside the vehicle, and that when he instructed her to exit it, she allegedly fell off the side of the flatbed in the dark onto the ground, incurring fractures and other injuries.
The plaintiff alleges several counts of negligence and cites medical expenses.
Crago seeks: actual and compensatory damages; pre- and post-judgment interest; attorney fees; and costs. Crago is represented by attorneys Eric Chaffin and Patrick Booth of Chaffin Luhana in Weirton. The case has been assigned to Circuit Judge David J. Sims.
