BECKLEY — A Raleigh County woman filed a lawsuit against a major retailer alleging multiple counts of premises liability in 2013.
Ruth Ann Tate filed a complaint against Wal-Mart Stores East LP in Raleigh Circuit Court May 14, claiming negligence in a July 2013 shopping experience.
According to the filing, the plaintiff was on the defendant’s premises located at 1330 Eisenhower Drive in Beckley on or about July 7, 2013 when she slipped and fell in a pedestrian walkway. Tate alleges that the defendant breached its duty of care by allowing water to stand in the entryway where patrons were required to walk.
Tate asserts that she incurred physical injuries to her knees, ankle, back and neck as a result of the defendant’s actions. She also claims that Wal-Mart falsely represented itself to be a safe, hazard-free environment for customers.
Alleging negligence, gross negligence, negligent misrepresentation, and breach of consumer protection, Tate avers mental pain and suffering; emotional distress; inconvenience; and loss of service, companionship, and enjoyment of life.
The plaintiff seeks compensatory damages, pre- and post-judgment interest, attorneys’ fees, and costs.
She is represented by Anthony Sparacino Jr. of Beckley. The case has been assigned to Judge H. Louis Kirkpatrick.
