Woman sues drivers of both vehicles in 2003 Charleston traffic accident

CHARLESTON – A woman seeks damages for injuries from the drivers of both vehicles involved in a 2003 Charleston traffic accident as well as the business for which one of the drivers was working.

In a suit filed Dec. 5 in Kanawha Circuit Court, Mary Kennedy claims she was the passenger in a 1992 Chevrolet Prizm driven by Theresa Karp, who was on duty with Loved Ones In Home Care LLC on Dec. 8, 2003. The suit says a 1990 Chevrolet Geo driven by Loretta Bays hit the car driven by Karp at the intersection of Ohio Avenue and Virginia Street West.

As a result of the accident, Kennedy claims she has suffered great pain and suffering of the mind and body, has incurred medical expenses, has suffered mental anguish, loss of capacity of enjoyment of life, annoyance, inconvenience and aggravation. She also claims she will continue to suffer and incur expenses in the future.

In the suit filed by Samuel F. Hanna, Kennedy lists Bays, Karp and Loved Ones In Home Care as defendants. She seeks joint and several damages, both punitive and compensatory as well as fees, costs and expenses.

The case has been assigned to Circuit Judge Jim Stucky.
