Woman sues Huntington Mall after tripping over curb

HUNTINGTON - A Cabell County woman is suing the owner of the Huntington Mall after injuring herself by tripping over a curb.

In a Dec. 20 suit, Betty Lou Lockhart is suing The Cafaro Company, claiming she was leaving the mall on Jan. 20, 2004, when she stepped off the curb on to the parking lot and fell to the pavement.

Lockhart alleges it was dark and there was inadequate lighting in the area. She claims she was unable to see the curb before she stepped off it.

The suit claims the fall was the result of negligence on the mall, which failed to provide adequate lighting in the area and neglected to warn people of the hazards of the curb.

Lockhart says she injured her right thumb, left hip and her right knee.

She is seeking damages in an amount not to exceed $75,000.

The case has been assigned to Judge David M. Pancake.
