WAYNE – A group of attorneys is suing a Wayne woman for refusal to pay litigation costs.
The attorneys -– Tyson, Hankins and Hatcher -– represented McCoy and 39 others in the West Virginia Federal District Court in Maxine Pack Harless, et al. v. Pen Coal Corporations in 2000.
McCoy and the other 39 defendants were known as the "Pack Heirs."
The attorneys entered into an agreement with the Pack Heirs that they would bear the costs of the proceedings.
The case settled in mediation in July 2004 by Federal Judge Joseph Goodwin and all the members of the heirs paid for their share proceedings except McCoy, who owed $25,723.
In July 2005, Federal Judge Robert Chambers ruled the costs were fair and reasonable. The suit claims McCoy refuses to acknowledge her share of the expenses.
The attorneys are seeking damages in the amount of $25,723.
