WHEELING - A couple is suing the Catholic Diocese of Wheeling-Charleston after being struck by a golf cart at a couples' retreat.
The suit was filed March 3 in Ohio County by Thomas F. Jennings and Carole P. Jennings.
In the suit, filed by Frank X. Duff, the plaintiffs claim that about two years ago, they were attending a married couples' retreat sponsored by the Diocese in Kearneysville. While walking along a sidewalk, they were hit from behind by a golf cart owned by the Diocese being driven by Vincent Vecera.
They claim Vecera was negligent and reckless in keeping a proper lookout and that the Catholic Diocese was negligent in allowing him to drive it.
As a result of the incident, Mr. Jennings sustained serious injuries to his left foot and knee and Mrs. Jennings suffered injuries to her right hip and knee, as well as other bodily injuries. Both continue to suffer medical costs and lost wages. They also claim they still suffer a great deal of pain and anguish, anxiety, permanent impairment, loss of ability to enjoy life, emotional distress, psychological injuries, aggravation, and inconvenience.
The plaintiffs seek compensation for their injuries and damages. They request a trial by jury.
The case has been assigned to Circuit Judge Martin J. Gaughan.
