Man sues for damages to home during TV servicing

WHEELING - A man is suing Circuit City Stores, Inc., DirecTV, Inc., and John Doe Contracting after his home was damaged during a satellite television system installation.

The suit was filed this month in Ohio County by Gerald Ames, Jr.

In the suit, filed by Shane M. Mallett, Ames claims that he entered into a contract last year requiring the defendants to install a DirecTV satellite system in his home. The system initially cost $19.96 with a service rate of $80.00 per month. On the fourth day of the agreement, John Doe Contractor arrived at Ames' home to install the system. Ames claims that the contactor acted negligently and failed to perform its duties in a workmanlike manner. Specifically, he claims that the contractor permanently damaged areas around the roof, windows, and walls of his home.

As a result of the incident, Ames has had to pay $3,000.00 in out-of-pocket expenses for repairs as well as the previous service fees. Aside from financial loss, he claims the incident has caused him to lose the enjoyment of his residence, annoyance, aggravation, and inconvenience.

Ames seeks compensatory and general damages in an amount not in excess of $75,000.00.

He seeks a trial by jury.

The case has been assigned to Circuit Judge Ronald E. Wilson.
