* Martin Douglas of Poca claims he was injured in a March 2004 accident when his car was hit by a tractor-trailer owned by WM Madison and driven by McQueen. He says those injuries were made worse in a May 2005 accident when he was hit by a van owned by Jerry N. Hilbert and driven by Garrett. His wife sues for loss of consortium.

The WVSSAC argues that it can make emergency rules because it is not a state agency, but a private association of schools.
