Agsten says it wasn't paid for JP Morgan construction

CHARLESTON - The Charleston company hired to renovate the JP Morgan building in Charleston has filed a lawsuit stating it is owed more than $150,000.

Agsten Construction Company names J.T. Magen & Company and JP Morgan Chase & Company as defendants in the suit, filed April 21 in Kanawha Circuit Court.

Fred F. Holroyd of Charleston firm Holroyd and Yost is representing Agsten, which already has filed a Notice of Mechanic's Lien with the Kanawha County Commission.

J.T. Magen was hired as the general contractor for a project in the JP Morgan Building located on Virginia Street in Charleston, and Agsten was hired as a subcontractor.

For services on the 11th floor, Agsten says it is owed $9,969.90.

For services on the 15th and 16th floors, Agsten says it is owed $88,823.40.

For services on the 17th floor, Agsten says it is owed $68,069.

Agsten claims to have spent more than $1 million in labor and material during the project, $166,862.30 of which is still owed to it. Agsten is also seeking court costs.

Judge James Stucky has been assigned the case.
