WINFIELD – The Putnam County Board of Education doesn't think it needs to install a storm water detention facility under a proposed school bus parking lot, so it's taking the matter to court.
The school board filed a lawsuit April 12 in Putnam Circuit Court against the Town of Winfield Board of Zoning Appeals.
In the suit, filed by attorney Lisa M. Moye, the school board says it applied for a building permit with Winfield to pave a parking lot for school buses and for a variance to avoid the necessity of installing the storm water detention facility.
At a public hearing on the matter March 13, the school board says it showed evidence that water runoff from the parking lot would have no detrimental effect and that it was entitled to the variance according to Winfield zoning ordinances.
No one at the hearing opposed the variance, the suit says. Still, at the end of the hearing, the zoning board denied the school board's variance request.
The case has been assigned to Circuit Judge Ed Eagloski.
