Woman sues Wheeling Island Racetrack over fall

WHEELING - A Pittsburgh woman says the condition of the parking lot at Wheeling Island Racetrack and Gaming Genter is to blame for her fall.

Barbara McClinton says she was a business invitee at Wheeling Island Racetrack Nov. 26, 2004 when she slipped and fell while walking in the parking lot.

She filed a lawsuit against Wheeling Island Gaming, Inc., April 21 in Ohio Circuit Court. She is represented by Mark A. Colantino of Weirton law firm Frankovitch, Anetakis, Colantino and Simon.

That law firm recently made headlines when M. Eric Frankovitch and Michael Simon had their appointments as special assistant Attorneys General by Attorney General Darrell McGraw, Jr. challenged and subsequently terminated.

McClinton is seeking a stipulation that states she may only receive $74,999. Any amount awarded to her over that, she says she will refund to the defendant.

She says she was "caused to fall by reason of the dangerous conditions presented on the premises, incuding, but not limited to, the parking lot on the defendant's premises."

McClinton adds that she has suffered severe and disabling injuries and was forced to seek medical treatment.
