CHARLESTON - A Monongalia County man fed up with calls to his mother's home filed a lawsuit against a Maryland-based law firm and Discover Financial Services.
In a complaint filed April 24 in Kanawha Circuit Court, David McGraw says Wolpoff and Abramson, LLP, has repeatedly called him despite being told that he is represented by counsel and that all calls should be directed toward it.
McGraw is represented by John W. Barrett.
McGraw says Discover Financial Services handed his debt over to Wolpoff and Abramson on March 1, and Wolpoff and Abramson began calling his mother's home.
On March 17, McGraw says he told a Wolpoff and Abramson employee that he had a lawyer, but adds that the firm has dunned him "every day since then."
"By engaging in the conduct described above, Defendants used unfair or unconscionable means to collect or attempt to collect a claim in violation of West Virginia Code," the complaint says.
Mcgraw is seeking actual damages and that the defendants pay $3,900 for each violation.
Judge Louis Bloom has been assigned the case.
