Couple files suit against occupants

CHARLESTON - A couple who leased their building in St. Albans to a company is suing that company for not paying rent.

Joseph and Elizabeth Wallace say the unpaid balance is more than $555,000 and are seeking that amount in a lawsuit filed April 26 in Kanawha Circuit Court.

Attorney John E. Dorsey filed the suit, which alleges that J.D. Lile, II and Lori L. Lile fell behind on rent and subletted without permission.

The Liles own Body Works and Painting, LTD, which is also listed as a defendant. Tri-L Enterprises, doing business as Steamatic of West Virginia, is also a defendant.

"Defendants defaulted in other obligations pursuant to the lease, including, but not limited to, the failure to fully pay rents due, failure to pay security deposit, assigning or subletting the premises without consent of Plaintiffs, failing to provide evidence of insurance upon the premises to Plaintiffs, failure to pay real estate taxes and other breaches or defaults," the complaint says.

The lease was activated Feb. 21, 2005 and terminated Jan. 2.

The complaint also states, "The defendants are wrongful and unlawfully withholding and detaining possession of the premises from Plaintiffs."

Judge Tod Kaufman has been assigned the case.
