Pizzeria Uno owners being sued for a third time

HUNTINGTON - Another lawsuit has been filed over the building of a Pizzeria Uno restaurant in Huntington.

Poca-based Carpet Craft Corp. filed a lawsuit April 28 in Cabell Circuit Court against Absolut-Huntington, a group of businessmen that includes Powerball winner Jack Whittaker.

Carpet Craft says it is owed $12,500 for work it performed on ceramic wall tile, slate and wood-patterned vinyl, as well as labor.

Paul J. Prunty of Huntington law firm Prunty Law Offices is representing Carpet Craft, which became the third company to file a breach of contract suit against Absolut-Huntington in a month.

On March 28, Architectural Interior Products filed one against Absolut-Huntington, claiming it was owed $3,777.25.

The foursome listed individually as defendants were Steve Neu, David Saul, Whittaker and Bruce Panley. Whittaker won a $315 million Powerball jackpot in Dec. 2002.

James Rupe Custom Builders followed with a lawsuit filed April 7 that claims Absolut-Huntington still hadn't paid $44,164.93 on a $230,000 contract.

Only Neu and Saul were listed as individual defendants on that suit.

Judge David M. Pancake has been assigned the Carpet Craft and James Rupe cases. John L. Cummings has been assigned the AIP case.
