CHARLESTON - A woman who slipped and fell in the Golden Corral of Cross Lanes is seeking $150,000 in damages.
Ruth McCallister filed the lawsuit May 8 in Kanawha Circuit Court against P.J.L. Enterprises of Sciotoville, Ohio, doing business as Golden Corral of Cross Lanes.
McCallister is represented by Charleston attorney Harold S. Albertson.
McCallister says she was a customer on May 9, 2004, when a water puddle accumulated on the floor and she slipped and fell in it.
"As a direct and proximate result of the Defendant's negligent, willful and reckless acts, the plaintiff received injuries to her body, as well as other physical and physiological damages which are permanent in nature, requiring past, present and future medical treatment," the complaint says.
The $150,000 amount she is seeking consists of compensatory and punitive damages, as well as attorneys' fees and court costs.
Judge Charlie King has been assigned the case.
Late last year, the restaurant was sued over a similar incident.
Delbert Lockhart claimed he was visiting the restaurant on March 6, 2004, when he stepped on a foreign substance on the floor. Lockhart says he believes the substance was grease tracked from the restaurant's kitchen.
When he stepped on the substance, he fell to the floor and was injured. Those injuries include connective tissue injuries to the lower back and right hip, according to his suit.
