Saturn of Charleston-Huntington sued again

CHARLESTON - Two women who bought a vehicle from Saturn of Charleston-Huntington are charging the dealership with misleading them about the vehicle's past.

Patricia Hatcher and Regina Lambert filed a lawsuit May 10 in Kanawha Circuit Court that alleges employees of Saturn of Charleston-Huntington told them a 2002 Saturn SC purchased in 2002 was new when it actually was a buyback vehicle.

It is the second such case filed against Saturn in three days by Charleston attorney Cameron S. McKinney of The Grubb Law Group. He helped Walt Darlak and Rebecca Barber file another one in Putnam Circuit Court on May 8.

Hatcher and Lambert say they entered into a contract Dec. 2, 2002, after being told the Saturn SC was pointed out to them by a Saturn sales associate.

They say the car was described as "new," though in Dec. 2005 they discovered it had a prior history of problems.

"Plaintiffs allege that Defendants sold them the subject motor vehicle without disclosing materials facts, including… the vehicle's prior history as a lemon buyback vehicle and the vehicle's prior repair history related to the buyback condition," the complaint says.

The lawsuit also alleges that the vehicle was not fully repaired prior to its resale.

Hatcher and Lambert want their contract cancelled, Saturn to be found in violation of the West Virginia Consumer Credit and Protection Act and damages, compensatory and punitive.

Judge James Stucky has been assigned the case.
