Another Pullman Square restaurant sued

HUNTINGTON - A produce company is suing Moe's Southwest Grill for paying for goods with bad checks.

Buck's Fruit Company filed a lawsuit against Moe's Knows West Virginia Management May 15 in Kanawha Circuit Court.

Fellow Pullman Square restaurant Pizzeria Uno has been sued three times for allegedly not paying its construction bills. Those lawsuits are directed toward Absolut-Huntington, a partnership that owns that particular Pizzeria Uno franchise and includes $315 million Powerball winner Jack Whittaker.

Buck's Fruit Company says it is owed $9,529.71 by Moe's Southwest Grill.

Moe's Southwest Grill's public relations group, Aurora Group Public Relations, said, "Due to a recent change in ownership, an oversight has occurred. This oversight will be resolved as soon as possible."

Charles C. Amos of Huntington law firm Barrett, Chafin, Lowry and Amos is representing Bucks, which is demanding the balance plus court costs.

Judge David Pancake has been assigned the case.
