Woman claims she was cursed at, wrongfully fired

CHARLESTON - A former employee at Lanier Worldwide Inc. is suing the company and two supervisors because she believes she was fired after she retaliated to being called a name on a company trip.

Amanda Davis filed the lawsuit May 16 in Kanawha Circuit Court and lists Lanier, James Malone and Curtis Gregory as defendants.

She says she was part of a conference in Pittsburgh on July 14, 2005, when she and some fellow employees met for dinner at a restaurant.

"Defendant Malone was visibly intoxicated at said dinner," the complaint says. "Defendant Malone became verbally abusive towards Plaintiff, calling her numerous expletives, including 'no-good bitch.'"

Davis added that she reported the incident to the Lanier Human Resources Department and was continually harassed afterward.

Davis worked at Lanier from Oct. 25, 2004, to Nov. 1, 2005. She says she informed the company that she needed time off because she was to be hospitalized with a ruptured cyst on Oct. 2, 2005.

She says the time off was granted, but she was fired three weeks later.

She is charging the defendants with: Wrongful termination; breach of contract; violation of the West Virginia wage payment and collection act; negligence; negligent infliction of emotional distress; and intentional infliction of emotional distress.

James Muldoon is the plaintiff's attorney. Davis is seeking liquidated and punitive damages.

Judge Charlie King has been assigned the case.
