CHARLESTON - A Kanawha County woman is suing the City of Charleston and Kanawha Regional Transportation Authority after she allegedly tripped over a hole.
Louise Morrison filed the lawsuit May 26 in Kanawha Circuit Court alleging that her fall was a result of the city's negligence. She says a hole in the pavement was allowed to go unfixed at the transit mall near the Charleston Town Center Mall.
Morrison says she "sustained permanent painful injuries and she will spend large sums of money in order to cure the injuries she sustained" in her complaint.
She claims that after exiting a bus on April 25, 2005, a large hole in the street caused her to fall. She is also suing Alternative Service Concepts of Pikeville, Ky., because the City of Charleston turned the claim over to it.
Morrison says ASC "has the audacity to claim that the plaintiff is more at fault than the city or Kanawha Regional Transportation Authority."
James C. Reed, Jr. is her attorney. They are seeking compensatory damages on counts against the City of Charleston and Kanawha Regional Transportation Authority and punitive damages on counts against ASC.
Judge Jennifer Bailey Walker has been assigned the case.
